Rail Infrastructure Project Reports

On November 30, 2016, the Board issued a final rule in EP 724 (Sub-No. 4), which required Class I railroads to report information on significant rail infrastructure projects on an annual basis, including a six-month update. The regulations governing reporting of such projects are codified at 49 C.F.R. § 1250.4.

In accordance with the regulations:

  • A “significant rail infrastructure project” refers to one that is expected to cost at least $75 million over its lifetime.
  • Reports must contain a brief description of each project, its purpose, location (state/counties), and projected completion date.
  • Reports must be submitted by March 1st and updated September 1st of each year.
